426. To ask the Minister for Housing, Planning, and Local Government his plans to introduce new legislation to provide for leave to apply for substitute consent in line with the environmental impact assessment, EIA, directive in view of a recent Supreme Court decision on planning; when it is intended to do so; and if he will make a statement on the matter. I am aware of the recent Supreme Court judgment to which the Question refers, concerning the leave to apply for substitute consent system under the Planning and Development Act 2000, as amended and its compatibility with the EIA Directive.

The judgment and its implications are currently being examined by my Department and any measures necessary to address the findings of the judgment will be brought forward in due course.
