329. To ask the Tánaiste and Minister for Justice and Equality the status of an application by a person (details supplied) to transfer to an Irish prison under the Transfer of Sentenced Persons Act 1995; the reason the application has been in the Office of the Chief State Solicitor for more than 12 months; when it will conclude its consideration of the application; and if he will make a statement on the matter. I am informed by the Irish Prison Service that it is aware of the application referred to, and that the application made on behalf of the person referred to is under consideration.

The Deputy will appreciate that this area is extremely complicated, has resulted in a number of legal challenges over the past number of years and that applications can take a considerable period of time to assess and complete.

I am advised by the Prison Service that all matters referred to the Chief State Solicitor’s Office in this instance are now complete. I am further advised that the application referred to is in the final stages of processing.

The Deputy will appreciate that I am not in a position to provide further information regarding this or any other individual case.
