To ask the Minister for Public Expenditure and Reform further to Parliamentary Question No. 78 of 26 September 2019 when the new guidance on the implementation of section 52(6) and (7) of the Public Service Pensions (Single Scheme and other Provisions) Act 2012 will be finalised; and if he will make a statement on the matter. As noted in my response to Parliamentary Question No. 78 of 26 September 2019, as result of a number of issues that have arisen in relation to the pensions benefit cap under section 52(6) and (7) of the Public Service Pensions (Single Scheme and other Provisions) Act 2012, and the implementation of guidance on it, my Department has carried out a review into the operation of those provisions.

As I have previously indicated,  I am hopeful that as a result of the review  it will ultimately be possible to issue new/revised guidance on the operation of the benefit cap for the direction of public service pension scheme administrators and I can confirm that work on the issues relating to section 52(6) and (7) is at an advanced stage.

Again, I would like to indicate to the Deputy my appreciation for his patience in relation to this matter, as I am aware that he has raised the review of the benefit cap on a number of occasions in the past.
