170. To ask the Minister for Public Expenditure and Reform the number of economic operators that have been disqualified from public tenders on the basis of the abnormally low tender provisions as per under Article 69 of 2014/24/EU; and the number of economic operators that have made a claim against the State after being disqualified from public tenders on the basis of the abnormally low tender provisions under the article. I wish to advise the Deputy that from 2014 to date, no public tender competitions ran by my Department have disqualified economic operators on the grounds outlined in the question. As such, no claims against the State have been brought on these grounds as a result of any public tender competitions ran by my Department.

The information above sets out the position in respect of the Department of Public Expenditure and Reform. If the Deputy wishes to obtain this information in respect of other Government Departments, separate questions should be submitted to the relevant Ministers.
