To ask the Minister for Rural and Community Development the number of appeals made to the Charity Appeals Tribunal under section 45 of the Charities Act 2009 in each year since being established; the number of cases heard and adjudicated on; and the number of cases in which an appeal was successful and not successful in each year. Section 75 (1) of the Charities Act 2009 provides for the establishment of the Charities Appeal Tribunal. The role of the Charity Appeals Tribunal is to hear and adjudicate on appeals against certain decisions of the Charities Regulatory Authority (the ‘Charities Regulator’).
The Rules for the Charities Appeals Tribunal were made under the Charity Appeals Tribunal (Charities Act 2009) Rules 2018, SI No. 209 of 2018. The Rules came into force on 4 July 2018.
To date no appeals under Section 45 have been received by the Tribunal since its establishment.
