1033. To ask the Minister for Employment Affairs and Social Protection the reason a person (details supplied) has not been granted farm assist; and if she will make a statement on the matter. [44839/18]

The application for farm assist by the person concerned was disallowed by a Deciding Officer of the Department on the grounds that he was not engaged in farming as defined by social welfare legislation.
I am advised by the Social Welfare Appeals Office that an appeal by the person concerned was referred on 5th September 2018 to an Appeals Officer who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing.
The Social Welfare Appeals Office functions independently of the Minister for Employment Affairs and Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.
I hope this clarifies the matter for the Deputy.
