To ask the Minister for Housing, Planning, Community and Local Government the policy in relation to third party submissions to the Mahon tribunal; if there is a list of all the submissions that have been kept or archived by the tribunal; and the location in which these submissions are stored. The procedure for third party submissions and other documentary materials that are required to be archived by the Tribunal of Inquiry into Certain Planning Matters and Payments (also known as the Mahon Tribunal) is provided for in sections 46 and 47 of the Civil Law (Miscellaneous Provisions) Act 2011 and the National Archives Act 1986. The relevant documents are in the process of being placed in storage with the storage company procured and contracted by OPW for Government archiving services.  All documents not in archive are presently under the control of the Tribunal at its offices in Dublin Castle.

Documents provided to the Tribunal which are not required to be stored under the above legislation are being returned by the Tribunal to the parties who provided same; or if not required to be returned, are being destroyed with the consent of said party. This process is on-going as there is a significant number of parties and documents involved.

The Tribunal compiled in excess of 600,000 records, generating 1.6 million pages of materials during the course of its work, and it is not practical to provide a specific list without further elaboration.
