Agriculture Scheme Payments

545. To ask the Minister for Agriculture, Food and the Marine the reason a person's (details supplied) farm payments have been frozen and have been directed to a bank; and if he will make a statement on the matter. [25773/17]

Where the Department is served with court orders, including Orders of Garnishee and orders for the appointment of receivers by way of equitable execution, the Department takes all necessary steps to comply with the specific terms of such orders.

The Department was served with a Conditional Order dated 6 March 2017 against a person with the same name and address as supplied with this question. The Order did not specify a herd number. A search of the Department's records indicated only one account with this name and address. The Department has since sought clarification from the Plaintiff's legal team and corrective action has been taken.  

I can confirm that no payments have been directed to a bank in this case as no payments became due to the herdowner since the Conditional Order was received.

To ask the Minister for Agriculture, Food and the Marine if his Department facilitates the redirection of a person's AEOS or GLAS farm payments to a financial institution if requested by court order; his views on this matter in view of the fact that payments such as AEOS and GLAS are payments in respect of works and expenditure incurred by the person; and if he will make a statement on the matter. Where the Department is served with court orders, including Orders of Garnishee and orders for the appointment of receivers by way of equitable execution, the Department takes all necessary steps to comply with the specific terms of such orders.

Where such an order provides for the attachment of payments made by the Department to a person under the Agri-Environmental Options Scheme or the Green Low Carbon Agri-Environmental Scheme for the benefit of the judgment creditor who has obtained the order, the Department takes the necessary steps to comply with the order.
