Disability Allowance Appeals

192. To ask the Minister for Social Protection if he will review the refusal of a decision in respect of a disability allowance dated 7 March 2017 in the case of a person (details supplied); if this inquiry will be accepted as basis for appeal; if a basic social welfare payment can issue in the interim while awaiting the result of the appeal; and if he will make a statement on the matter. The Social Welfare Appeals Office has advised me that there is no record of any appeal having been received from the person concerned. In light of the Deputy’s representations, a form has been issued by the Appeals Office to the person concerned advising him that if he wishes to appeal the decision he should complete and return the form to that office setting out the grounds for his appeal of the Department’s decision. On receipt of his reply an appeal will be registered and processed in the normal manner.

The person concerned should contact his local Intreo Office regarding his possible entitlement to basic supplementary welfare allowance.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.

I hope this clarifies the matter for the Deputy.
