To ask the Minister for Jobs, Enterprise and Innovation her views on a discrepancy between the European Economic and Social Committee approved wording of the EU Company Law Directive of 2003 and the detail which was finally placed into legislation (details supplied); the impact of this discrepancy on those Irish banks which have shares quoted on the Irish stock market; and if she will make a statement on the matter. The European Commission adopted its proposal to amend Directive 1978/660/EEC on 9 July 2002 (COM (2002)259/2 final). As part of the EU co-decision legislative process, the European Parliament proposed amendments to the text of that proposal, and some of these are reflected in the final text of what is now Directive 2003/51/EC.
What impact, if any, those amendments have had on Irish banks is a matter of speculation.
