As indicated in my response to in December, some State bodies may need to have regard to the definition of 'beneficial ownership' set out in article 3(6) of 4AMLD (). However, because the legal ownership, governance and control of State Bodies is set out in considerable detail in legislation, this should not prove too difficult to establish particularly since for most bodies that are Government-owned and Government-controlled, their legal and beneficial ownership will be identical.
The Deputy should note that officials from my Department are currently consulting with the Department of Public Expenditure and Reform to examine how the requirements of the Directive can be addressed by State owned entities.
