149. To ask the Minister for Agriculture, Food and the Marine if the Statute of Limitations 1957 prohibits, in any way, his Department's ability to retake or penalise any agriculture overpayments which have taken place past a certain period; and if he will make a statement on the matter. [31026/16]

The Statute of Limitations 1957, as amended, imposes limits on my Department's ability to recoup overpayments. The Act does not prohibit proceedings being initiated but provides a defence in certain circumstances.
