826. To ask the Minister for Agriculture, Food and the Marine if Riversdale Avenue, Dublin 6, is an urban area for the purposes of section 19 of the Forestry Act 2014; and, if under this Act, a person would need a felling licence in this area. [13633/16]

The Forestry Act 2014 has not yet been commenced and therefore the provisions of the Forestry Act 1946 still apply. Under section 37(4) (d) of the 1946 Act a person does not require a felling licence to fell trees which are standing within one hundred feet of any building other than a wall or temporary structure.
