Compulsory Purchase Orders

To ask the Minister for Jobs, Enterprise and Innovation if his Department has considered the consequences of a recent court judgement (details supplied) on the compulsory purchase order process; if legislative change is required or envisaged in this regard; and if he will make a statement on the matter. In November 2015, the Supreme Court set aside a compulsory purchase order issued by IDA Ireland in respect of lands in County Kildare owned by Mr. Thomas Reid. The Court found that the specific legislation that IDA Ireland had relied upon – Section 16 of the Industrial Development Act, 1986 – could not be utilised in the circumstances of the case in question.

My Department is carefully considering the judgment and its implications and it is expected that these issues will be considered by Government in the near future.
