107. To ask the Minister for Finance further to my many written questions on this issue to confirm if there has been any update in relation to the Setanta Insurance issue following the recent decision indicating that claims should be made through the Motor Insurers' Bureau of Ireland; to confirm if he has received a clarification relating to this decision being appealed; and if he will make a statement on the matter. As the Deputy is aware, progress on the Setanta Insurance issue has been awaiting the outcome of legal proceedings in the case of the Law Society of Ireland versus the Motor Insurers' Bureau of Ireland (MIBI).  On 4 September 2015, the High Court held that the MIBI is liable in respect of claims against the policy holders of Setanta.  This decision was subsequently appealed by the MIBI and the Court of Appeal upheld the High Court decision in the case.  The MIBI has announced that it has decided to apply to the Supreme Court for leave to appeal the Court of Appeal judgement.

I expect to be in a better position to inform the House further after the legal proceedings are concluded.
