Basic Payment Scheme Applications

271. To ask the Minister for Agriculture, Food and the Marine why he has not issued payment to persons (details supplied) in County Cork under the basic farm scheme. [5545/16]

EU Regulations governing the Basic Payment Scheme provide that all farmers who were eligible to receive a direct payment greater than €100 in 2013 (Single Payment, Grassland Sheep Scheme, Burren Life Scheme, Beef Data Scheme) have an automatic allocation right under the Basic Payment Scheme in 2015. The persons named did not receive a direct payment in 2013 and therefore do not hold an allocation right into the Basic Payment Scheme. The persons named purchased entitlements in 2014 and received Single Payment on those entitlements for that year, however, this does not provide them with an allocation right into the new Basic Payment Scheme in 2015. The persons named have also submitted a 2015 Private Contract Clause application to my Department seeking the transfer of land and corresponding entitlements by lease as Transferees. The Transferor in the case has an outstanding 2013 Single Payment that requires to be finalised in order to render them eligible to transfer the land and entitlements for 2015. This 2013 payment will be finalised shortly, following which the Private Contract Clause application can be finalised to facilitate payment to the persons named.

272. To ask the Minister for Agriculture, Food and the Marine when he will issue the balance of a payment to a person (details supplied) in County Cork. [5547/16]

The person named submitted a 2015 Private Contract Clause application to my Department seeking the transfer of land and entitlements by lease as Transferee to the Company name shown. As the person named was not farming in 2013 he did not hold an allocation right into the Basic Payment Scheme. In May 2014 my Department had issued a letter to the Company to advise them to transfer the allocation rights from the person named to the Company name. The documents required to transfer the allocation right into the Company name were not received by my Department until 1 February 2016. The allocation right has now been transferred across to the Company name, the Private Contract Clause application has been fully processed and the outstanding payment under the Basic Payment Scheme will be made shortly.

273. To ask the Minister for Agriculture, Food and the Marine the reason for the delay in issuing a payment to a person (details supplied) in County Cork. [5590/16]

The person named submitted an application for allocation of entitlements under the ‘Scottish Derogation’ category of the Basic Payment scheme and processing of this application is at an advanced stage. Processing of applications involves administrative and on farm checks and verification of land details submitted under the 2015 Basic Payment Scheme application. These checks are required under EU Regulation. In the coming days when all checks have been completed and processing has been finalised, my Department will correspond directly with the person named and advise him of the outcome of his application.

274. To ask the Minister for Agriculture, Food and the Marine when he will issue payment to a person (details supplied) in County Laois under the basic payment scheme; and if he will make a statement on the matter. [5595/16]

The person named submitted a Private Contract Clause application as transferor on the 25th May, 2015 to transfer 69.23 Basic Payment scheme entitlements. He also submitted an application to have his Basic Payment Scheme entitlement value reviewed under force majeure circumstances. Both applications have been deemed successful. This resulted in 71.31 Basic Payment Scheme entitlements being established for the person named with a total value ( including greening ) of €7,704.58. The Private Contract Clause application has resulted in the transfer of 69.23 entitlements with a total value ( including greening ) of €7,586 to another person while 1.08 entitlements with a total value (including greening) of €118.58 has remained in the account of the person named. Payment will issue to the person named in the coming days.
