256. To ask the Tánaiste and Minister for Social Protection why a decision was made not to grant a disability allowance to a person (details supplied) in County Wicklow; if she is aware that this person has been deemed unfit to work by a doctor, due to a range of medial conditions; if the appeal recently made by this person will be successful; and if she will make a statement on the matter. The application from the person in question was disallowed on 8 October 2015 on the grounds that he does not fulfil the medical conditions for the scheme and that he failed to demonstrate that he satisfies the means test.

The person in question was advised of the decision and the reasons for it. He was advised of his option to submit further documentary evidence for review and also of his right to appeal the decision to the Social Welfare Appeals Office. To date neither option has been exercised.
