1186. To ask the Minister for Transport, Tourism and Sport further to Parliamentary Question No. 353 of 22 October 2015, his plans to introduce regulations for legislation on the carriage of passengers by rickshaws, trikes and other novelty vehicles; if he will indicate a time frame for same; and if he will make a statement on the matter. At present, there is no legislation in place to regulate the carriage of passengers by rickshaws. Rickshaws by their nature operate at a local level. Local authorities regulate many activities at local level through bye-laws made under local government regulation. In response to concerns (primarily of a health and safety nature), and following a consultation process with relevant stakeholders, Dublin City Council (DCC), has prepared draft bye-laws under the Local Government Act 2001 to regulate the operation of rickshaws.

As I set out in my reply to Parliamentary Question No. 353 of 22 October 2015, it is my understanding that DCC, subject to receipt of certain legal clarifications, intends to bring the draft bye-laws, which would provide for a licensing regime for rickshaws, before the next meeting of the Strategic Policy Committee of the Council for its consideration.

In relation to the licensing of trikes and other three wheel vehicles as small public service vehicles (SPSV), my Department, in consultation with the National Transport Authority, is examining and assessing the necessary regulatory changes that would be required. My Department is liaising with the Road Safety Authority in relation to the issue of roadworthiness testing of such vehicles which would be a necessary condition for licensing as SPSV's. However, from the initial discussions to date any regulatory change will take some time.
