120. To ask the Minister for Justice and Equality if it is the policy of the Data Protection Commissioner to inform complainants, when issuing draft reports of determinations to them, that the determination is indeed a draft and that the complainant may make further submissions in regard to their complaint prior to a final determination being issued. Under the Data Protection Acts 1988 and 2003, the Data Protection Commissioner is independent in the performance of her duties, including the conduct of investigations in response to complaints received by her Office. Such investigations, and any related enforcement actions, are subject to relevant statutory provisions and due process requirements.
