To ask the Minister for Environment, Community and Local Government the provisions that are made in order that individual members of a residents' association do not become personally liable for an open public space, in a situation where a residents' association has taken over responsibility for the public space from a developer. [28872/15]

I am not aware of any legal provisions in relation to this issue, which may be a matter in relation to which legal advice should be sought. It is open to the residents of an estate to request the local authority to take in charge the roads and open spaces under section 180 of the Planning and Development Act 2000.
