369. To ask the Minister for Public Expenditure and Reform if the proposed date for Ireland to enshrine the new European Union public procurement directives, that will require all public bodies to apply more socially and economically just criteria to all public tenders, will be in advance of the required deadline of April 2016; and if he will make a statement on the matter. I intend to ensure that Directive 2014/24/EU on public procurement is transposed into Irish law by the end of 2015 at the latest  and the other two Directives covering the Utilities sector (2014/25/EU) and Concession Contracts (2014/23/EU) will  be transposed by the required deadline.

The criteria for the award of contract will be based on the provisions in the Statutory Instrument that implements each Directive into national law and they will be applied in accordance with the subject matter or nature of the contract. These criteria should be set out in the procurement documentation and tenderers will be required to comply with applicable obligations in the fields of environmental, social and labour law that apply where the works are executed or the services are provided in compliance with European Union, national law or relevant international environmental, social and labour law provisions.
