To ask the Minister for Justice and Equality the procedure to be followed in order to regularise his position in regard to residency, in the case of a person who is a non-European Union national who has worked and paid taxes here for the past ten years, has never been in receipt of a social welfare payment, has a child with special needs, and is anxious to regularise their position in regard to residency; and if she will make a statement on the matter. I am advised by the Irish Naturalisation and Immigration Service (INIS of my Department) that if the person referred to wishes to regularise their illegal status in the State that they should be advised to make an application to INIS making a full disclosure of their circumstances in the State where a decision will then be made on the merits of their case.

To ask the Minister for Justice and Equality the procedure to be followed in order to regularise a person's residency in the case of a non-European Union national, who has lived and worked here and paid their taxes for more than eight years, and is anxious to regularise residency status in respect of their and own and their family's case; and if she will make a statement on the matter. If the person whose details were supplied has made an application for asylum or subsidiary protection, the Deputy will be aware that it is not the practice to comment on such applications for so long as they remain in the protection process. The position in this regard is in accordance with Section 19 of the Refugee Act 1996 (as amended) which provides for the protection of the identity of asylum applicants.

Protection applicants are issued with a temporary residence permission pending a final decision on their application.

To ask the Minister for Justice and Equality the current position in regard to the determination of residency status in the case of a person (details supplied) in Dublin 22, in view of the fact that the person concerned is not in possession of a current national passport, has been unable to renew an out-of-date Cameroon passport, and has not been able to obtain a new passport; and if she will make a statement on the matter. I refer the Deputy to my reply to Parliamentary Question No.118 of 23 April 2015 which stated that the person in question has been granted residence permission in the State based on their parentage of an Irish citizen child. This decision was conveyed in writing to the person in question by letter dated 01 April, 2015.

I am advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that the person in question has been contacted in writing by letter dated 22 April, 2015 in relation to the issues raised by the Deputy, to which a response is awaited. Once the person concerned provides a response to INIS the matter may be considered further.

Queries in relation to the status of individual immigration cases may be made directly to the INIS of my Department by e-mail using the Oireachtas Mail facility which has been specifically established for this purpose. This service enables up to date information on such cases to be obtained without the need to seek information by way of the Parliamentary Questions process. The Deputy may consider using the e-mail service except in cases where the response from the INIS is, in the Deputy’s view, inadequate or too long awaited.
