176. To ask the Minister for Social Protection when a person (details supplied) in County Donegal may expect a decision from the social welfare appeals office, further to an oral hearing held on 7 January 2015; and if she will make a statement on the matter. [9319/15]

I am advised by the Social Welfare Appeals Office that an Appeals Officer having fully considered all of the available evidence, including that adduced at the oral hearing, has decided to allow the appeal of the person concerned. The person concerned has been notified of the Appeals Officer’s decision.

The oral hearing of this case was held on 28 January 2015 and not on 07 January 2015 as suggested by the Deputy.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.
