I am advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that the person concerned has applied for a right of residency in the State, accompanied by a right to work, based on their parentage of an Irish citizen child. While the person concerned has submitted some of the required documentation, other items of documentation remain outstanding. Against this background, a representative of the INIS wrote to the person concerned on 21 August, 2014 requesting the submission of specific documentation. There is no record of the requested documentation having been submitted to date. The position in the State of the person concerned can be further considered upon receipt of the requested documentation.

Queries in relation to the status of individual immigration cases may be made directly to the INIS of my Department by e-mail using the Oireachtas Mail facility which has been specifically established for this purpose. This service enables up to date information on such cases to be obtained without the need to seek information by way of the Parliamentary Questions process. The Deputy may consider using the e-mail service except in cases where the response from the INIS is, in the Deputy’s view, inadequate or too long awaited.

I am advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that, in response to a notification pursuant to the provisions of Section 3 of the Immigration Act 1999 (as amended), the person concerned has submitted written representations.

These representations, together with all other information and documentation on file, will be fully considered, under Section 3 (6) of the Immigration Act 1999 (as amended) and Section 5 of the Refugee Act 1996 (as amended), in advance of a final decision being made.

To ask the Minister for Justice and Equality the current status in respect of their residency application process in the case of a person (details supplied) in County Laois following a High Court settlement and withdrawal of deportation order; and if she will make a statement on the matter. I am informed by the Irish Naturalisation and Immigration Service (INIS) of my Department that following a comprehensive and thorough examination of the asylum claim and application for subsidiary protection, and a detailed examination of the representations he submitted for consideration under Section 3 of the Immigration Act 1999 (as amended), a Deportation Order was signed on 8 March 2011 in respect of the person referred to by the Deputy.

The person concerned initiated judicial review proceedings challenging the Deportation Order made in respect of him. These proceedings have recently been settled. I am informed that the Deportation order will be revoked as part of the settlement terms.
