109. To ask the Minister for Education and Skills if she is satisfied that the primary online database operated by her Department is in compliance with data protection legislation; and the basis upon which she is making this statement. [3956/15]

The Department of Education and Skills has consulted with the Data Protection Commissioner in relation to the collection and retention of individual pupil information for the Primary Online Database in December 2013. They have stated that PPSN can now be collected by schools with the purpose being it is a requirement of the Primary Online Database. The ODPC were satisfied the Department of Education had a "legitimate and proportionate" purpose for requesting personal details on primary school pupils for a new national database. The retention policy was discussed with the Data Protection Commissioner's office and no issues of concern were raised.
