74. To ask the Minister for Agriculture, Food and the Marine when outstanding payments for the past four years will be paid in respect of a person (details supplied); the reason for the delay in making these payments; and if he will make a statement on the matter. [45424/14]

There is an ongoing issue in relation to commonage land claimed by the person named in the townland of Drummin. Following consultation betwe en officials of my Department and the Office of the Attorney General, my Department was advised that in order to claim rights on this commonage, applicants must also have lowland in this townland. As the person named has no lowland in Drummin, unfortunately, he cannot be paid on this land. The Drummin Commonage land has been removed from the annual applications of the person named without the imposition of any penalty.

Payments have been made in respect of 2011, 2012 and 2013 to the person named on his declared eligible land. Payments will is sue shortly in respect of 2014, again on the basis of the eligible land declared.
