99. To ask the Minister for Social Protection if she will accept this request for appeal against decision to refuse disability allowance in the case of a person (details supplied) in County Kildare in view of the availability of conclusive medical evidence to the effect that they will not be in a position to take up employment in the foreseeable future; and if she will make a statement on the matter. The Social Welfare Appeals Office has advised me that an appeal by the person concerned has not been received by that office. A form has been forwarded to the person concerned requesting him to state the grounds for his appeal of the Department’s decision. On receipt of his reply the appeal will be opened and processed in the normal manner.
The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.
