612. To ask the Minister for Agriculture, Food and the Marine to set out the position regarding payment owed to a person (details supplied) in County Cork. [22862/14]

In order to comply with EU requirements, the 2009 Single Farm Payment/Disadvantaged Areas Scheme application of the person named was selected for a Cross Compliance inspection. This inspection identified breaches in relation to the cattle identification and registration requirements, specifically the requirement to maintain an accurate herd register for 5 years, resulting in a 5% penalty being applied to the 2009 payments under both the Single Farm Payment and Disadvantaged Areas’ Schemes. The breaches identified did not result in a penalty being applied to payments under the REPS 4 Scheme.

The person named was notified of the inspection decision on 18 December 2009. The person named appealed this decision and following a further examination of the case a letter, upholding the original inspection decision, issued on 5 June 2012. The person named was also informed of the right to appeal the outcome of the review to the independent Agriculture Appeals office within 3 months. The Agriculture Appeals Office has no record of any appeal from the person named.

613. To ask the Minister for Agriculture, Food and the Marine if a person (details supplied) in County Offaly will qualify under the single farm payment scheme for 11.72 hectares for lands worked for over seven years. [22902/14]

The person named established 4.42 entitlements under the Single Payment Scheme in 2005 with a unit value of €755.68 and a total value of €3340.11. As the person named farmed and received a direct payment in 2013 he has established an allocation right whereby he will be allocated entitlements under the new Basic Payment Scheme in 2015. The number of entitlements that will be allocated to the person named will be based on the number of eligible hectares he declares in 2013 and 2015, whichever is lower. In 2013 he declared 11.72 eligible hectares. If he declares the same number of eligible hectares in 2015, he will be allocated 11.72 entitlements under the Basic Payment Scheme, if he declares less than 11.72 hectares in 2015, the number of entitlements allocated will be based on that lesser figure.
