37. To ask the Minister for Education and Skills if he will publish the State's official response in the EU Commission state aid investigation of state aid to Bus Éireann and its answer to the question by EU Commission in C 31/07 Paragraph 82 of its letter to him (details supplied); and if he will make a statement on the matter. As I advised the Deputy in my reply of 26th February, the release of the documents referred to is a matter for the relevant European Commission Directorate.

The State's response to the investigation referred to, which commenced in 2007, was coordinated by the Department of Transport, Tourism and Sport.

My Department supplied any information to that Department as required by the Commission.

The State has maintained that the operation and administration of PSO transport services and the school transport scheme respectively are in accordance with the provisions of EU law.

I understand that a Commission decision on this investigation is awaited.
