Rural Environment Protection Scheme Payments

287. To ask the Minister for Agriculture, Food and the Marine when a person (details supplied) in County Monaghan will receive their rural environment protection scheme payment; and if he will make a statement on the matter. [54817/13]

The person named commenced REPS 4 in February 2009 and received payments for the first four years of their contract.

REPS 4 is a measure under the current 2007-13 Rural Development Programme and is subject to EU Regulations which require detailed administrative checks on all applications to be completed before any payments can issue. Administrative checks in respect of the 2013 payments have been finalised in this case and the 75% payment amounting to €2,101.87 has now been cleared for payment . The remaining 25% balancing payment will issue shortly.

288. To ask the Minister for Agriculture, Food and the Marine the reason 9.33 hectares were deemed as claw back on the REP scheme 4 payment in respect of a person (details supplied) in County Cork; and if he will make a statement on the matter. [54827/13]

The person named commenced REPS 4 in February 2008 and received payments for the first five years of their contract.

REPS 4 is a measure under the current 2007-13 Rural Development Programme and is subject to EU Regulations which require detailed administrative checks on all applications to be completed before any payments can issue. In November 2011 an adjusted Plan was received from the Agricultural Consultant of the person named outlining a change of status of 9.33 hectares of NATURA lands contained in the original Agri-environment Plan submitted to my Department in 2008. Consequently, in November 2013 a letter issued from my Department advising the person named of a clawback in respect of the 9.33 hectares of Natura designated lands and affording him the right of review by the Regional Inspector. Following the receipt of an appeal from the person named and additional material from the Agricultural Consultant, this matter is now the subject of a review by my officials and the person named will be notified of the outcome once the review has been completed.If he is dissatisfied with the outcome of the review, he will have the right of appeal to the Agriculture Appeals Office.
