291. To ask the Minister for Social Protection if an oral hearing will be carried out in relation to a person (details supplied) in County Kilkenny in view of the fact that they did not receive notification of the scheduled oral hearing for 18 November 2013; and if she will make a statement on the matter. I am advised by the Social Welfare Appeals Office that an Appeals Officer, having fully considered all of the available evidence, decided to disallow the appeal of the person concerned by way of a summary decision on 29th November 2013. I am advised that the Social Welfare Appeals Office has agreed to re-open the appeal of the person concerned by way of granting another oral hearing. The person concerned will be contacted when the arrangements of his/her appeal have been finalised.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.
