466. To ask the Minister for Environment, Community and Local Government the level of compliance with European Union directives within his ministerial areas of responsibility; the current fines resulting from non-compliance and potential fines resulting from present non-compliance the State is or may be exposed to; and if he will make a statement on the matter. Within my direct areas of responsibility, there are currently nine infringement cases instituted against Ireland by the European Commission in respect of European Union directives, which represents a significant improvement upon the situation when I assumed office in March 2011.

There are currently no outstanding fines resulting from non-compliance. The quantum of fines to be imposed in any infringement case is determined by the Court of Justice of the European Union if and when the matter is brought to Court, so it is not possible to estimate in advance potential fines. In any event, my Department is actively seeking to resolve all the outstanding infringement cases before they reach the stage where fines could be imposed.
