To ask the Minister for Environment, Community and Local Government the legislative basis, either through an Act of the Oireachtas or statutory instrument, that sets the basis for voting hours here for Presidential, General, European and local elections, in addition to referendums; and if he will make a statement on the matter. Electoral law provides that polling at an election or referendum shall be between the hours of 7 a.m. and 10.30 p.m. for a period of not less than twelve hours. The legislative basis is as follows -
- Section 7 of the Presidential Elections Act 1993 as amended by section 52 of the Electoral (Amendment) Act 2001,
- Section 96 of the Electoral Act 1992 as amended by section 23 of the Electoral (Amendment) Act 2001,
- Section 10 of the European Parliament Elections Act 1997 as amended by section 51(b) of the Electoral (Ame ndment) Act 2001,
- Section 26 of the Local Government Act 2001 and
- Section 1 3 of the Referendum Act 1994 as amended by section 55(a) of the Electoral (Ame ndment) Act 2001.
