Bullying in the Workplace

668. To ask the Minister for Social Protection if FÁS has a duty of care to those working on community employment schemes in relation to a responsibility to protect them from bullying and harassment; and the steps open to these workers to have that right protected. [35541/13]

From 1st January 2011 policy and funding responsibility for FÁS functions in relation to employment and community employment services was transferred to this Department in accordance with the provisions of the Social Welfare (Miscellaneous Provisions) Act 2011. All Sponsors of Community Employment schemes must ensure compliance with all statutory and legal obligations including employment equality legislation and employment issues including harassment. Participants on Community Employment Schemes have protection under legislation in the Employment Equality Act 1998 and the Equality Act 2004.
