To ask the Minister for Environment, Community and Local Government with regard to the Private Residency Tenancies Board, if it is the case that pending litigation on behalf of the PRTB has been and can be carried out subject to the availability of funding; and if he will make a statement on the matter. I have no function in the operational matters of the Private Residential Tenancies Board (PRTB), an independent statutory body established on 1 September 2004 under the Residential Tenancies Act 2004. The Act regulates the tenant-landlord relationship in the private rented residential sector and provides, inter alia, for the enforcement of determination orders, where such have not been complied with, by application to the Circuit Court by either a party to the determination order or by the Board itself. Given the discretionary nature of this power, the Board exercises it in the context of the circumstances pertaining to each case.
