177. To ask the Minister for Justice and Equality further to Parliamentary Question No. 539 of 19 February 2013, if he will undertake a review the case of a person (details supplied) in County Kildare; and if he will make a statement on the matter. [24996/13]

As outlined in my previous reply to the Deputy, the person concerned has been refused a declaration of Refugee Status in the State. He has also been refused Subsidiary Protection and a Deportation Order has been made in respect of him. Judicial Review proceedings challenging the Deportation Order and the refusal of Subsidiary Protection were brought before the High Court on 24 September 2011 and are still ongoing. As the matter is, therefore, still sub judice I do not propose to comment further. I should remind the Deputy that queries in relation to the status of individual immigration cases may be made directly to INIS by Email using the Oireachtas Mail facility which has been specifically established for this purpose. The service enables up-to-date information on such cases to be obtained without the need to seek this information through the more administratively expensive Parliamentary Questions process.

To ask the Minister for Justice and Equality further to Parliamentary Question No. 177 of 25 April 2013, if he will indicate whether the case in question remains sub judice or whether the courts decided on 25 June 2012 to set aside the deportation order and require a re-examination of the case of a person (details supplied) in County Kildare; and if he will make a statement on the matter. I am advised by the Irish Naturalisation and Immigration Service that judicial review proceedings were instituted in the High Court challenging the refusal of subsidiary protection and the making of a Deportation Order in relation to the person concerned on 11 August 2011. Until all court related matters have been dealt with I do not propose to comment further on the case. I should remind the Deputy that queries in relation to the status of individual immigration cases may be made directly to INIS by Email using the Oireachtas Mail facility which has been specifically established for this purpose. The service enables up-to-date information on such cases to be obtained without the need to seek this information through the more administratively expensive Parliamentary Questions process.
