Single Payment Scheme Eligibility

355. To ask the Minister for Agriculture, Food and the Marine the position regarding single farm payment that were claimed by a person as an individual in 2011, but the farming set up is now run by them through a limited company; if the company can continue to claim the payments originally activated by the individual; the additional measures, if any, they need to take; and if he will make a statement on the matter. Where an individual farmer sets up a limited company the Single Payment entitlements may be transferred to that company provided the main business of the company is carrying on the business of farming. A Transfer of Entitlement application form, available on my Department’s website, must be completed requesting the transfer of entitlements. The person must ensure that they include the appropriate paperwork such as the Company Registrar Printout and the Memorandum of Articles of Association. Payments may continue to be claimed by the Company by submitting a valid Single Payment application form which has been signed appropriately and includes sufficient eligible hectares to support the number of entitlements.

The herd number should also be transferred from the individual farmers to the Company.
