Rural Environment Protection Scheme Payments

To ask the Minister for Agriculture, Food and the Marine when a person (details supplied) in County Cork will recieve their REP scheme 4 payment; and if he will make a statement on the matter. [13166/13]

The person named commenced REPS 4 in June 2008 and received payments for the first two years of their contract. REPS 4 is a measure under the current 2007-13 Rural Development Programme and is subject to EU Regulations which require detailed administrative checks on all applications to be completed before any payments can issue. Following an on-farm inspection on 9 November 2010 my Department decided to reject the REPS Agri-environmental Plan of the person mentioned due to non- compliances associated with Measure 3, the requirement to Protect and Maintain Watercourses, Waterbodies and Wells. The person named appealed the decision to my Department on 24 February 2011 and the decision was upheld. The person named subsequently appealed the decision to the Agriculture Appeal's Office. Following an Oral Hearing on the 23 May 2012, the Agriculture Appeals Office decided to partially allow the appeal based on the establishment in May 2011 of new facilities. The decision provides for the imposition of a 100% penalty in respect of 2010, a partial payment in 2011 and full payment of entitlement under the scheme in 2012. The outstanding payments will issue shortly.

The person named was approved for participation in the 2011 Agri-Environment Options Scheme with effect from the 1 September 2011 and full payment totalling €1,060.93 issued in respect of 2011. Under the EU Regulations governing the Scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before any payment can issue. Payments in respect of the 2012 Scheme year are subject to a similar administrative checking process which includes verification of capital investment through checks on receipts. These checks have been successfully completed and full payment totalling €3,575.11 issued in respect of the 2012 scheme year – 75% payment issued on 6 March and the balancing 25% payment issued on 7 March 2013.
