This application for carer's allowance for the person concerned was awarded on the 23rd of August 2012 at the rate of €151.30 per week from 13th of October 2011. The person in question was assessed with weekly means of €89.10 per week. The person concerned has appealed this decision. All relevant papers have been prepared and will be sent to the Social Welfare Appeals Office (SWAO) today. The SWAO, in due course, will be in touch with the person in question regarding the progress of the appeal.

The Social Welfare Appeals Office has advised me that an appeal, by the person concerned, was registered in that office on 27th November 2012. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought. When received, the case will be referred to an Appeals Officer who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
