To ask the Minister for Social Protection the basis on whcih it was decided to allow an appeal from 2 August, the date of oral hearing and not from the date of application in the case of a person (details supplied) in County Kildare; and if she will make a statement on the matter. [43351/12]

The Social Welfare Appeals Office has advised me that the reasons for the partial allowance of the Carers Allowance for the person concerned were outlined in the letter issued on 25 September 2012. Based on the evidence, including that adduced at the oral hearing and subsequent submission, the Appeals Officer was of the view that the care recipient was not so invalided or disabled so as to require full time care and attention when the application was made but considered it appropriate to decide that she does require full time care and attention from the date of the oral hearing 2 August 2012 and, as such, the appeal is allowed from that date. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
