Pension Provisions

To ask the Minister for Social Protection the entitlement to State pension transition in the case of a person (details supplied) in County Kildare who wishes to continue with work despite being potentially eligible for pension; and if she will make a statement on the matter. [41183/12]

In order to be eligible for a State pension (transition) the person must be aged 65 years, be retired from insurable employment, and satisfy certain other qualifying conditions.

They may satisfy the retirement condition if they are employed but earning less than €38 per week, and paying PRSI at Class J. Alternatively, if self-employed, they can be considered retired if they earn less than €5,000 per year.

The retirement condition is no longer applicable when they reach 66 years of age and transfer to State pension (contributory).

The person concerned is approaching the age of eligibility for State pension (transition). A claim form has been sent to him. If it is likely that he will satisfy the above conditions, he should complete and return the form to the Department. On receipt of the completed claim form, his entitlement to pension will be fully examined and he will be notified of the outcome without delay.
