I wish to draw the Deputy's attention to the application of the Central Bank's 'Code of Conduct on Mortgage Arrears' which applies to the mortgage loan of a borrower or borrowers which is secured by the primary residence. Lenders must apply the Code to borrowers who are in arrears or in pre-arrears. In the case of joint borrowers, who notify the lender in writing, that they have separated or are divorced, and that they are in arrears or may be in arrears in the future, the lender must treat each borrower as a single borrower under the Code. A copy of the Code and of the 'Mortgage Arrears - A Consumer Guide to dealing with your Lender ' is available on the Central Bank's website.
