Personal Insolvency Bill

Question 521: To ask the Minister for Justice and Equality if the Personal Insolvency Bill will deal with a situation in which joint mortgage holders having split up and are in a situation where one is actually paying the mortgage and the second in a position of needing to apply for personal insolvency [29875/12]

The Deputy will appreciate that as the Personal Insolvency Bill has yet to be published, it would neither be possible nor appropriate at this point for me to comment on any particular potential insolvency scenario that might arise. In any event the Deputy will have an opportunity to raise this matter during the debate on the Bill when it comes before the House in the very near future.

This is a real issue which I'm sure will take up a large percentage of people seeking to avail of the financial solutions proposed by the Personal Insolvency Bill.

I trust from the Ministers response that he has not concidered a break up under a Joint Mortgage which is a very obvious high frequency matter, otherwise he might have easily confirmed the matter has been concidered.

This is a very common problem in the ROI at the moment and should be given the attention it deserves. One partner may wish to stay in the house and the other may wish to avail of Bankruptcy or one of the debt resolution schemes proposed by the new bill.
