Question 491: To ask the Minister for Agriculture, Food and the Marine the steps he has taken since he came to office to implement the Ombudsman report into a family (details supplied) and their exclusion from the lost at sea scheme; and if he will make a statement on the matter. [16401/12]

As the Deputy will be aware, this matter centres on the refusal of the Department of Agriculture, Food and the Marine to carry out the recommendation of the Ombudsman in 2009 to award compensation of €245, 570 to a family who made an unsuccessful application for replacement capacity under the Lost at Sea Scheme. I am reviewing the case at the moment, and I will make a decision in the light of a careful examination of all aspects of the matter, including legal and other advice available to me.
