Question 86: To ask the Minister for Jobs, Enterprise and Innovation the position regarding the annual salaries paid, from 2004 to 2011 inclusive, for a body (details supplied) under his remit; when this body will be brought under the remit of the Freedom of Information Act, having regard to the fact that it was expected to be done shortly as stated in its 2007 annual report; and if he will make a statement on the matter. The matter referred to by the Deputy in the first part of the question is an operational matter for the body concerned, which is independent in the exercise of its functions, and is not one in which I have a direct role. In accordance with the Code of Practice for the Governance of State Bodies, details of the salary of the Chief Executive are published in the body's Annual Report.

In relation to Freedom of Information legislation, due to its quasi-judicial function, the body concerned was not a listed body for FOI purposes on its establishment. The question of the body's inclusion under FOI legislation in respect of its administrative records is a matter which will be considered further with my colleague the Minister for Public Expenditure and Reform, who has responsibility for that legislation, in the event of a further revision of the First Schedule to the Act. The last amendment to the First Schedule by way of Statutory Instrument extending the list of bodies designated was in 2006.
