Question 374: To ask the Minister for the Environment, Community and Local Government with regard to An Bord Pleanála and planning, after a planning application has been refused by a local authority, whether the four weeks allowed to make an appeal by the applicant to An Bord Pleanála is a law or simply a guideline; and if he will make a statement on the matter. Section 37(1) of the Planning and Development Act, 2000 provides that an applicant for permission and any person who made submissions or observations in writing in relation to the planning application to the planning authority in accordance with the permission regulations and on payment of the appropriate fee, may, at any time before the expiration of the period of four weeks beginning on the day of the decision of the planning authority, appeal to the Board against a decision of a planning authority.
