Question 206: To ask the Minister for the Environment, Community and Local Government the status of the lease of the foreshore licence at Burtonport Harbour to Donegal County Council; the date the licence was applied for to his Department; the date Donegal County Council and the fee Donegal County Council paid his Department for the lease; and if he is satisfied with the process in which this case has been dealt with. The application involves the proposed lease of an area of foreshore by Donegal County Council and a proposal by the Council to sub-lease a portion of the foreshore concerned to a third party. It has come to my Department's attention that the nature of the proposal for which the Council had originally intended to make the third party sub-lease has changed substantially. The proposed changes to the third party lease arrangements raise a number of legal issues on which my Department has sought advice. Given the complexity of the issues involved processing of the application cannot be moved forward until the advices of the Chief State Solicitor's Office are received.
