Question 379: To ask the Minister for Social Protection the number of successfully appealed cases in 2010 and 2011 that were initially refused based on failure to satisfy the habitual residence condition. [5454/12]

The number of cases relating to the habitual residence condition which were successful on appeal - i.e. either allowed in full or partially allowed - was 743 in 2010 and 2,369 in 2011.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
