Question 162: To ask the Minister for the Environment, Community and Local Government the status and details of the planning enforcement proceedings or any other legal action which has been instituted by Mayo County Council or Ballina Town Council against the developer of a housing estate (details supplied) in County Mayo together with details of all reports prepared by the councils or at its request pertaining to outstanding planning matters including sanitary and road problems affecting this estate. The enforcement of the conditions attached to a planning permission is a matter for the relevant planning authority and I have no role in the matter. Under section 30 of the Planning and Development Act 2000, I am specifically precluded from exercising any power or control in relation to any particular case with which a planning authority or An Bord Pleanála is or may be concerned, including cases of planning enforcement.
