Question 193: To ask the Minister for Justice and Equality when he expects to publish a Bill on mental capacity; if he intends that Ireland will ratify the UN Convention on the Rights of People with Disabilities following the publication of this legislation; and if he will make a statement on the matter. The Government Legislation Programme, published on 11 January 2012, indicates that the Mental Capacity Bill is expected to be published in this session. The Bill will reform the law on mental capacity taking into account the Law Reform Commission's Report on Vulnerable Adults and the Law. The enactment of new mental capacity legislation is one of the core elements of the remaining work to be completed towards ratifying the UN Convention on the Rights of Persons with Disabilities.
It is the Government's intention to ratify the UN Convention as quickly as possible, taking into account the need to ensure that all necessary legislative and administrative requirements under the Convention are being met.
